This Notice explains how Engear uses your Personal Data.

Collection of Personal Data

“Personal Data” means information about you from which you can be identified, including but not limited to name, identification number, birth certificate number, passport number, nationality, address, telephone number, fax number, banking information, credit card details, race, gender, date of birth, marital status, residency status, educational background, financial background, personal interests, email address, your occupation, your position in your company, details of your company, industry of employment, any information about you that you provide to Engear in registration forms, application forms, or similar forms and/or any information about you that has been or may be collected, stored, used, and processed by Engear from time to time, including sensitive personal data such as data related to health, religious beliefs, or similar beliefs.
The provision of your Personal Data is voluntary. However, if you do not provide Engear with your Personal Data, Engear will not be able to process your Personal Data for the Purposes and Additional Purposes as listed below.
If you are an agent, seller, supplier, or service provider, the provision of your Personal Data is mandatory, and failure to provide your Personal Data may violate applicable laws or regulations, and may result in Engear being unable to remunerate you for providing services or products or making payments to you for products or services provided.

Source of Obtaining Your Personal Data

In addition to the Personal Data you provide to Engear directly, Engear may collect your Personal Data from various sources such as:

When you fill out application forms or registration forms;
From public sources such as directories;
From Engear’s Facebook pages, if you follow, “like,” or are a follower of those pages;
From credit reporting agencies;
When you interact and communicate with Engear at any events or activities;
When you enter contests organized by Engear;
From various entities or divisions under Engear; or
By using Engear’s websites, which include all websites operated by Engear under its respective brand names (“Websites”). Your Personal Information may also be collected from the “cookies” used on the Websites.

Purpose of Processing

Engear may use and process your Personal Data for its business and Engear’s activities, including but not limited to the following purposes (“Purposes”): –

Where you are an Engear customer:

To fulfill Engear’s obligations under any contracts made with you;
To provide you with the services or products you request;
To process your subscription and deliver the subscription to you;
To process your purchase or request for advertising space;
If you have requested materials from the resource center or library, to process your application, deliver materials to you, and provide you with a license for the content you want to use;
To process your participation in any events, activities, focus groups, research studies, contests, promotions, polls, surveys, or any production;
To process, manage, or verify your subscription application with Engear and provide you with benefits offered to customers;
To verify your purchase and process payments related to any products or services you request;
To understand and analyze our sales and your needs and preferences;
To develop, enhance, and provide products and services to meet your needs;
To process exchanges or returns of products;

Where you are an agent, seller, supplier, or service provider:

For the purpose of remunerating you for providing services or products;
To facilitate or enable inspections that may be required by Engear for employment purposes;
To process payments related to products or services provided by you;
To contact you or your company;
For Engear to respond to your questions, comments, and feedback;
To communicate with you for any purposes listed in this Notice;
For internal administrative purposes such as audits, data analysis, database records;
For the purposes of detection, prevention, and prosecution of crime;
For Engear to comply with its obligations under the law; and
You agree to Engear using and processing your Personal Data for the Purposes and Additional Purposes as identified in this Notice.

Marketing and Promotion Purposes

Engear may also use and process your data for other purposes (“Additional Purposes”):

Sending news alerts, newsletters, update news, emails, promotional materials, special offers, festive greetings from Engear, partners, sponsors, or advertisers;
To inform and invite you to events or activities organized by Engear, partners, sponsors, or advertisers;
To process your registration to join or attend events or activities and to communicate with you about your attendance at such events or activities;
To share your Personal Data with partners, advertisers, event management companies, or sponsors who may communicate with you to market their products, services, events, or promotions; by mail, phone calls, short message services (SMS), in person, and/or by email.

Your Personal Data may be transferred, stored, used, and processed in other jurisdictions outside Malaysia, to companies under Engear located outside Malaysia, and/or where Engear’s servers are located outside Malaysia. You understand and agree to the transfer of your Personal Data outside Malaysia as stated herein.
Your Personal Information may be transferred, accessed, or disclosed to third parties for the Purposes and Additional Purposes. Furthermore, Engear may involve other companies, service providers, or individuals to perform functions on its behalf, and may consequently grant access to or disclose your Personal Data to such service providers or third parties.
The third parties referred to in this Section include (without limitation):

Delivery agents such as newspaper vendors and newspaper agents;
Engear partners and advertisers, including parties with whom Engear has collaborations for certain events, programs, and activities;
Event management companies and event sponsors;

Service providers, including information technology (IT) service providers for infrastructure, software, and development work;
External professional advisors and auditors, including legal advisors, financial advisors, and consultants;
Other entities within Engear; and

Access & Correction Requests and Inquiries, Limiting the Processing of Personal Data

Engear reserves the right to impose a fee for access to your Personal Data in the amount permitted under the law.
Regarding your right to access and/or correct your Personal Data, Engear has the right to deny your request for access and/or make any corrections to your Personal Data for reasons permitted by law, such as where the expense of providing access to you is disproportionate to the risks or your privacy or the privacy of others.
If you do not want your Personal Data to be collected through “cookies” on the Websites, you can disable “cookies” by adjusting your internet browser settings to disable, limit, or disable “cookies,” by clearing your browsing history, and by clearing the cache from your internet browser.

Websites may contain links to third-party websites. Please note that Engear is not responsible for the collection, use, maintenance, sharing, or disclosure of data and information by third parties. If you provide information directly to those websites, the privacy policies and terms of service on those websites will apply, and Engear is not responsible for the information processing practices or privacy policies of those websites.

Personal Information from Minors and Other Individuals

As a parent or legal guardian, please do not allow minors (individuals under the age of 18) under your care to provide Personal Data to Engear. If Personal Data is provided to Engear, you hereby agree to the processing of the Personal Data of such minors and personally accept and agree to be bound by this Notice and take responsibility for their actions.
In certain circumstances, you may have provided personal data about other individuals (such as your spouse, family members, or friends), and in such cases, you represent and warrant that you have the authority to provide their personal data to Engear and that you have obtained their consent for the processing of their personal data and use in the manner stated in this Notice.

Acknowledgment and Consent

By communicating with Engear, using Engear’s services, purchasing products from Engear, or through your continued engagement and employment with Engear, you acknowledge that you have read and understood this Notice and agree to the use, processing, and transfer of your Personal Data by Engear as stated in this Notice.

Engear reserves the right to modify, update, or amend the terms of this Notice at any time by placing a notice that has been updated on the Website. By continuing to communicate with Engear, using Engear’s services, making purchases of products from Engear, or through your continued engagement and employment with Engear following modifications, updates, or amendments to this Notice, such actions will signify your acceptance of any modifications, updates, or amendments.

In case of any discrepancies between the English version and other language versions, the English version shall prevail.
